1. Agreement to Terms
By accessing or using JokeStack (jokestack.com or jokestack.pl), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. By accepting these terms, you confirm that you are at least 18 years old or the age of majority in your jurisdiction. Our service is intended for adults only, and you represent that you meet this age requirement.
2. Description of Service
JokeStack is a web-based application designed to help comedians:
- Write, organize, and manage comedy material
- Create and manage setlists
- Track joke performance and status
- Connect with other comedians through the Comedy Buddy feature
- Discover and share information about events
- Collect and view feedback from event attendees
- Sell tickets and manage sign-ups for events (where enabled by the Organizer)
3. User Accounts
To use JokeStack, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Be responsible for all activities under your account
- Notify us immediately of any unauthorized access
4. Age Requirement
JokeStack is intended for users who are 18 years of age or older. By using our service, you represent and warrant that you are of legal age to form a binding contract. We do not knowingly collect information from or provide services to minors.
5. Acceptable Use
You agree not to use JokeStack to:
- Violate any laws or regulations
- Infringe on intellectual property rights of others
- Upload malicious code or harmful content
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to our systems
- Use the service for any commercial purpose without authorization
6. Comedy Buddy Feature
The Comedy Buddy feature allows users to connect with other comedians. By using this feature, you acknowledge and agree that:
- You use this feature entirely at your own risk and responsibility
- JokeStack does not verify, screen, or conduct background checks on users
- You are solely responsible for verifying the identity and intentions of other users
- We strongly recommend against meeting people from our platform in person
- If you choose to meet someone in person, take appropriate safety precautions (meet in public places, inform friends/family, etc.)
- JokeStack is not responsible for any interactions, disputes, or incidents arising from connections made through this feature
- You should never share sensitive personal information (home address, financial details, etc.) with other users
7. Events
JokeStack allows users to discover and share information about events. Regarding this feature:
- We do not verify, validate, or endorse any events listed on our platform
- Event information is provided by users and event organizers, and we make no guarantees about its accuracy
- We are not responsible for the content, quality, safety, legality, or proper execution of any events
- We do not control or moderate event images, descriptions, or any other content posted by organizers
- JokeStack is not the organizer of events and is not a party to the agreement for attending an event
- Attendance at any event is entirely at your own risk
- We recommend verifying event details independently before attending
8. Event Feedback System
Event organizers may use our feedback collection feature for their events. Please note:
- Feedback may be provided by anonymous users and guests
- We do not validate, verify, or moderate feedback content before it is displayed
- Users can write anything they want in feedback forms
- We are not responsible for the accuracy, truthfulness, or appropriateness of feedback
- Feedback represents the opinions of individual users, not JokeStack
- Event organizers use this feature at their own discretion and risk
9. Content Ownership
You retain all rights to the comedy material, jokes, notes, and content you create using JokeStack. By using our service, you grant us a limited license to:
- Store and display your content within the application
- Process your content to provide service features
- Make backups of your content for service reliability
We will never share, publish, or use your comedy material without your explicit permission.
10. Subscription and Payment
JokeStack offers both free and paid subscription plans:
- Free plans have limitations on projects and features
- Paid subscriptions are billed monthly or annually
- You can cancel your subscription at any time
- Refund requests can be submitted to team@jokestack.com and will be considered on a case-by-case basis
- We reserve the right to change pricing with 30 days notice
- Payment processing may experience interruptions or failures - we cannot guarantee uninterrupted payment functionality
- You acknowledge that payment systems may not always work as expected
These subscription/payment terms apply to JokeStack plans. Ticket payments for events are handled separately under the Ticket Sales sections below and are processed via third-party providers and event Organizers.
11. Service Availability and Third-Party Dependencies
We strive to provide reliable service but cannot guarantee uninterrupted access. Important disclaimers:
- Our service depends on third-party providers including Supabase (database), Resend (email), and Render (hosting)
- Any of these third-party services may experience downtime, data loss, or discontinuation
- We do not guarantee that your data will be available indefinitely
- We are not responsible for data loss resulting from third-party service failures
- We may modify, suspend, or discontinue any part of the service at any time
- We are not liable for any service interruptions or data loss from any cause
- Regular backups are recommended, but we do not guarantee data recovery
12. Data Security and Device Responsibility
While we implement security measures, you acknowledge that:
- No internet-based service is completely secure
- You are responsible for the security of your own devices
- We are not responsible if someone gains control of your device and deletes, modifies, or accesses your data
- You should use appropriate device security measures (passwords, encryption, antivirus, etc.)
- Data breaches, hacking, or unauthorized access may occur despite our security efforts
- We are not liable for any damages resulting from security breaches or device compromise
13. Termination
We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, you may lose access to your content. You may delete your account at any time from the settings page.
14. Limitation of Liability
JokeStack is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- We make no guarantees about service availability, reliability, or data preservation
- We are not liable for any indirect, incidental, consequential, or punitive damages
- We are not responsible for any interactions between users or with third parties
- We are not liable for content posted by users or event organizers
- We are not responsible for any losses resulting from third-party service failures
- We are not responsible for event cancellations, rescheduling, entry denial, venue rules, safety issues, or the Organizer’s performance of the event
- Our total liability shall not exceed the amount you paid us in the past 12 months
- You use our service entirely at your own risk
15. No Warranties
We make no warranties or representations about:
- The accuracy, reliability, or completeness of any content on the platform
- The suitability of our service for any particular purpose
- The behavior or identity of other users
- The accuracy of event information
- The availability or functionality of payment systems
- The permanence or security of your data
16. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes via email or through the application. Continued use of the service after changes constitutes acceptance of the new terms.
17. Governing Law
These terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.

19. Ticket Sales – Platform Role and Organizer Responsibility
JokeStack provides tools that allow users to sell tickets for events created on the Platform. The event organizer is the user who created the event on the Platform ("Organizer") and is solely responsible for the event and its execution. By purchasing a ticket, you enter into an agreement regarding event attendance directly with the Organizer. JokeStack acts as a technical intermediary in the ticket sales process and is not the event organizer and not a party to the agreement for delivering the event.
- The Organizer is solely responsible for the event description, attendance terms, entry rules, age restrictions, venue rules, and compliance with applicable laws.
- JokeStack does not verify the legality of events or the Organizer’s legal capacity to sell tickets; payment-related verification may be performed by Stripe (Stripe Connect).
- The Organizer is responsible for meeting all formal/legal obligations related to ticket sales and attendance, including issuing invoices/receipts if required.
20. Payments, Fees and Stripe Connect
Ticket payments are processed by third-party payment providers (in particular Stripe). Funds are paid out to the Organizer via Stripe Connect after deducting Stripe fees and Platform fees (if applicable).
- Platform fees may vary and are communicated during the Organizer’s ticket configuration.
- Availability of payment methods (e.g., BLIK/cards) depends on payment providers and may change; JokeStack does not guarantee any specific payment method.
- Some payments may be asynchronous (e.g., BLIK) and confirmation may be delayed in accordance with Stripe’s standard behavior.
21. Payment Confirmation, Ticket Issuance and Delays
A ticket is considered valid only after the payment is confirmed as completed (e.g., provider status "succeeded"). JokeStack may send an email with the ticket (e.g., PDF/QR code) as transaction confirmation; this does not override the Organizer’s or venue’s entry rules.
- For asynchronous payments, confirmation may be delayed; until confirmation, an order may remain pending.
- JokeStack may use temporary holds (soft reservations) to prevent overselling; holds may expire automatically if payment is not confirmed in time.
- Buyers are responsible for providing accurate contact details (especially email).
22. Ticket Delivery, Issue Handling and Support
Tickets are delivered electronically (e.g., email, PDF, QR code). Buyers should also check spam/promotions folders and verify the contact details they provided.
- JokeStack is not responsible for non-delivery caused by email providers, spam filters, or incorrect buyer data.
- In case of ticket issues (missing email, incorrect data), the buyer should first contact the Organizer, who has access to sales and transaction records.
- In justified cases, the Organizer may contact JokeStack technical support.
23. Ticket Rules, Entry Validation and Invalidation
Tickets are non-personalized unless the Organizer states otherwise in the event description. The Organizer may define additional rules (e.g., transfer rules, required documents).
- Entry validation may be performed by scanning QR codes using Platform tools by the Organizer or accounts authorized by the Organizer in the app.
- Tickets may be invalidated in cases of suspected fraud, abuse, Terms violations, or payment reversals (chargebacks).
- JokeStack is not responsible for denied entry based on Organizer rules, venue rules, public order, or safety considerations.
24. Refunds, Complaints and Event Cancellation/Rescheduling
Refund policies, event-related complaints, and buyer communications are the Organizer’s responsibility, unless mandatory law provides otherwise. The Organizer should describe refund rules in the event description when selling tickets via the Platform.
- The Platform may provide technical tools enabling refunds through Stripe, generally until the event starts, net of Stripe fees and Platform fees.
- The Platform does not guarantee that refunds will always work smoothly (e.g., if funds were already paid out to the Organizer by Stripe). In such cases, the Organizer must resolve the matter directly with the buyer.
- If an event is cancelled or rescheduled, the Organizer is responsible for notifying all buyers and handling refunds or ticket transfers to a new date.
If you consider the event description (including refund/attendance rules) insufficient, you should not purchase a ticket.
25. Payment Disputes (Chargebacks/Disputes) and Payout Holds
In the event of chargebacks/disputes or suspected abuse, the Organizer (as the connected Stripe account holder) is responsible towards the payment provider, unless mandatory law provides otherwise.
- Stripe and/or JokeStack may hold payouts or restrict ticketing features in cases of suspected abuse, Terms violations, Stripe requirements, or legal non-compliance.
- JokeStack may provide transactional data and logs required by payment providers or competent authorities to the extent permitted by law.
26. Event Sign-ups (RSVP) and Seat Reservations
The Platform may allow event sign-ups (e.g., open mic/open stage). Sign-ups may constitute a seat reservation or only an expression of interest, as described by the Organizer.
- JokeStack does not guarantee that a sign-up secures a spot, and the Organizer is not required to honor sign-ups unless explicitly stated in the event description.
- Details (capacity limits, ordering rules, participant requirements) should be specified by the Organizer in the event description.
- JokeStack may remove submissions or content that violates law, these Terms, or community standards, and may take anti-abuse measures (spam/bots).
27. Event Feedback – User Content and Rules
The Platform allows users to submit event feedback. Feedback may be anonymous, and users may sign it voluntarily. JokeStack does not pre-moderate feedback and is not responsible for its content.
- Illegal content is prohibited, including hate speech, threats, defamatory content, violations of personal rights, copyright infringement, and sharing third-party personal data.
- Organizers cannot delete feedback; users may locally hide selected entries in their app.
- Feedback may not be used for marketing (e.g., ads, website quotes) without the author’s consent. Any party using content/data found on the Platform is solely responsible for lawful use.
28. Ticket Buyer Data and Post-Purchase Communication
JokeStack acts as a data controller for ticket buyers’ personal data within the scope of Platform operations. Data may also be processed by the payment provider (Stripe) and shared with the Organizer to the extent necessary to run the event (e.g., attendee list, entry validation, operational contact).
- The Organizer receives buyer data provided during checkout (e.g., email and optional name).
- The Organizer may not use such data for marketing without a separate buyer consent; the Organizer is fully responsible for any unlawful use.
- Purchasing a ticket implies consent to receive transactional emails related to the order and event (e.g., confirmation, tickets, operational updates).
Marketing emails (if any) should provide an easy opt-out mechanism (unsubscribe link).
By using JokeStack, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You confirm that you are at least 18 years old and accept all risks associated with using our service.
