Terms of Service

1. Agreement to Terms

By accessing or using JokeStack (jokestack.com or jokestack.pl), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. By accepting these terms, you confirm that you are at least 18 years old or the age of majority in your jurisdiction. Our service is intended for adults only, and you represent that you meet this age requirement.

2. Description of Service

JokeStack is a web-based application designed to help comedians:

• Write, organize, and manage comedy material
• Create and manage setlists
• Track joke performance and status
• Connect with other comedians through the Comedy Buddy feature
• Discover and share information about events
• Collect and view feedback from event attendees
• Manage sign-ups for events (where enabled by the Organizer)

3. User Accounts

To use JokeStack, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

4. Age Requirement

JokeStack is intended for users who are 18 years of age or older. By using our service, you represent and warrant that you are of legal age to form a binding contract. We do not knowingly collect information from or provide services to minors.

5. Acceptable Use

You agree not to use JokeStack to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious code or harmful content
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Use the service for any commercial purpose without authorization

6. Comedy Buddy Feature

The Comedy Buddy feature allows users to connect with other comedians. By using this feature, you acknowledge and agree that:

• You use this feature entirely at your own risk and responsibility
• JokeStack does not verify, screen, or conduct background checks on users
• You are solely responsible for verifying the identity and intentions of other users
• We strongly recommend against meeting people from our platform in person
• If you choose to meet someone in person, take appropriate safety precautions (meet in public places, inform friends/family, etc.)
• JokeStack is not responsible for any interactions, disputes, or incidents arising from connections made through this feature
• You should never share sensitive personal information (home address, financial details, etc.) with other users

7. Events

JokeStack allows users to discover and share information about events. Regarding this feature:

• We do not verify, validate, or endorse any events listed on our platform
• Event information is provided by users and event organizers, and we make no guarantees about its accuracy
• We are not responsible for the content, quality, safety, legality, or proper execution of any events
• We do not control or moderate event images, descriptions, or any other content posted by organizers
• JokeStack is not the organizer of events and is not a party to the agreement for attending an event
• Attendance at any event is entirely at your own risk
• We recommend verifying event details independently before attending

8. Event Feedback System

Event organizers may use our feedback collection feature for their events. Please note:

• Feedback may be provided by anonymous users and guests
• We do not validate, verify, or moderate feedback content before it is displayed
• Users can write anything they want in feedback forms
• We are not responsible for the accuracy, truthfulness, or appropriateness of feedback
• Feedback represents the opinions of individual users, not JokeStack
• Event organizers use this feature at their own discretion and risk

9. Content Ownership

You retain all rights to the comedy material, jokes, notes, and content you create using JokeStack. By using our service, you grant us a limited license to:

• Store and display your content within the application
• Process your content to provide service features
• Make backups of your content for service reliability

We will never share, publish, or use your comedy material without your explicit permission.

10. Subscription and Payment

JokeStack offers both free and paid subscription plans:

• Free plans have limitations on projects and features
• Paid subscriptions are billed monthly or annually
• You can cancel your subscription at any time
• Refund requests can be submitted to [email protected] and will be considered on a case-by-case basis
• We reserve the right to change pricing with 30 days notice
• Payment processing may experience interruptions or failures - we cannot guarantee uninterrupted payment functionality
• You acknowledge that payment systems may not always work as expected

11. Service Availability and Third-Party Dependencies

We strive to provide reliable service but cannot guarantee uninterrupted access. Important disclaimers:

• Our service depends on third-party providers including Supabase (database), Resend (email), and Render (hosting)
• Any of these third-party services may experience downtime, data loss, or discontinuation
• We do not guarantee that your data will be available indefinitely
• We are not responsible for data loss resulting from third-party service failures
• We may modify, suspend, or discontinue any part of the service at any time
• We are not liable for any service interruptions or data loss from any cause
• Regular backups are recommended, but we do not guarantee data recovery

12. Data Security and Device Responsibility

While we implement security measures, you acknowledge that:

• No internet-based service is completely secure
• You are responsible for the security of your own devices
• We are not responsible if someone gains control of your device and deletes, modifies, or accesses your data
• You should use appropriate device security measures (passwords, encryption, antivirus, etc.)
• Data breaches, hacking, or unauthorized access may occur despite our security efforts
• We are not liable for any damages resulting from security breaches or device compromise

13. Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, you may lose access to your content. You may delete your account at any time from the settings page.

14. Limitation of Liability

JokeStack is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We make no guarantees about service availability, reliability, or data preservation
• We are not liable for any indirect, incidental, consequential, or punitive damages
• We are not responsible for any interactions between users or with third parties
• We are not liable for content posted by users or event organizers
• We are not responsible for any losses resulting from third-party service failures
• We are not responsible for event cancellations, rescheduling, entry denial, venue rules, safety issues, or the Organizer’s performance of the event
• Our total liability shall not exceed the amount you paid us in the past 12 months
• You use our service entirely at your own risk

15. No Warranties

We make no warranties or representations about:

• The accuracy, reliability, or completeness of any content on the platform
• The suitability of our service for any particular purpose
• The behavior or identity of other users
• The accuracy of event information
• The availability or functionality of payment systems
• The permanence or security of your data

16. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or through the application. Continued use of the service after changes constitutes acceptance of the new terms.

17. Governing Law

These terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.

19. Ticket Purchases

JokeStack offers a ticketing feature that lets event organizers sell tickets directly to attendees via Stripe. Important information for buyers:

• The seller of the ticket is the event Organizer, not JokeStack. JokeStack operates only as the technical platform and payment intermediary.
• Payment is processed by Stripe, which receives your card details directly. JokeStack never stores full card numbers.
• The refund policy, cancellation rules, and consumer rights in case of cancellation or rescheduling are the Organizer's responsibility and are shown on the event page before checkout. You must accept them to complete a purchase.
• Under Polish Ustawa o prawach konsumenta, the statutory 14-day right of withdrawal for distance contracts does not apply to tickets for a specific date/time event (art. 38 pkt 12 of the Act). Refunds for event cancellation or rescheduling are handled by the Organizer according to their refund policy.
• A ticket is delivered electronically (PDF + email) after successful payment. If you do not receive your ticket within 15 minutes, please contact the Organizer or [email protected].
• The buyer pays the ticket price set by the Organizer plus a separate platform fee, both shown clearly at checkout. The Organizer receives exactly the ticket price; the platform fee covers Stripe processing and the JokeStack service and is retained by JokeStack.
• The platform fee is NON-REFUNDABLE. If a refund is issued through the JokeStack app, only the ticket price is returned to the buyer; the platform fee stays with JokeStack. The Organizer may, at their sole discretion and on their own responsibility, refund the platform fee portion out-of-band (e.g. via bank transfer) — JokeStack does not manage such refunds and is not a party to them.
• Tickets are linked to the email address you provide at checkout. Do not share your ticket — a QR code can only be scanned once.

20. Personal Data — Ticket Buyers (GDPR)

When you purchase a ticket, we process your personal data in accordance with the EU General Data Protection Regulation (GDPR / RODO). Details:

• Data controller for ticket issuance and customer service: the event Organizer (contact details shown on the event page and on your ticket PDF).
• Joint controller for payment processing and platform security: JokeStack ([email protected]).
• Categories of data processed: email address, optional full name, buyer IP address, payment status, order and ticket identifiers. Card details are processed directly by Stripe and are not accessible to us.
• Purpose and legal basis: (a) performance of the sales contract — art. 6(1)(b) GDPR; (b) accounting and tax obligations — art. 6(1)(c) GDPR; (c) fraud prevention, abuse detection, and platform security — art. 6(1)(f) GDPR (legitimate interest).
• Recipients: Stripe (payment processor), Resend (email delivery), our hosting provider, and the event Organizer. We do not sell your data.
• Retention: order and ticket data are retained for the period required by Polish tax and accounting law (typically 5 years from the end of the tax year). Security logs are retained up to 12 months.
• Your rights: access, rectification, erasure, restriction, data portability, and objection. You may also lodge a complaint with the Polish data protection authority (Prezes UODO).
• To exercise any of these rights, contact the Organizer (for order-related data) or [email protected] (for platform-level data).
• Ticket purchase does not create a JokeStack user account. If you later register with the same email, your prior tickets will be linked automatically.

21. Performance Recordings

Premium users can attach a single audio or video recording to each performance, or link a YouTube video. The following rules apply:

• Free users cannot upload audio or video recordings — they may only attach YouTube links (which use no JokeStack storage).
• Per-file caps: video up to 500 MB (MP4 or QuickTime), audio up to 200 MB (MP3, AAC, WebM, WAV).
• Per-account storage caps: 10 GB on the paid plan, 1 GB during the 14-day post-signup premium trial.
• If your premium subscription lapses, your existing recordings remain accessible for 30 days (read-only grace period). After 30 days they are permanently deleted from our storage and cannot be recovered. To preserve them, download them before the grace period ends or upload them to YouTube and replace the recording with a YouTube link.
• We send a warning email at lapse and again 7 days before deletion (i.e. on day 23 of the grace period).
• Deleting a performance also deletes its attached recording. There is no trash or undo.
• You retain all rights to your recordings. We store them only to provide the service and never share, publish, or use them without your explicit consent.

22. AI Tools and Token Wallet

JokeStack offers AI-powered tools (joke writing assistance, speech-to-text transcription, set creation, and similar features). The following rules apply:

• AI usage is metered in tokens. Each plan includes a monthly token allowance; usage resets at the start of each billing period.
• If you exhaust your monthly allowance, you may purchase additional token top-ups. Top-ups are one-time purchases that do not auto-renew and roll over until consumed.
• Top-up purchases are non-refundable once tokens have been used. Unused top-up balances may be refunded at our discretion within 14 days of purchase by emailing [email protected].
• We may change the underlying AI model(s) we use at any time without notice. Different models may have different token costs per request.
• Inputs you submit to AI tools are sent to third-party model providers (currently Anthropic and/or OpenAI) for processing. We do not use your inputs or outputs to train models, and our providers contractually do not train on API inputs.
• AI outputs are generated automatically and may contain errors, inaccuracies, or content you did not intend. You are responsible for reviewing AI output before using or sharing it.
• We may rate-limit, throttle, or temporarily disable AI features to protect service availability or prevent abuse.
